By visiting our site or purchasing anything from us, you engage in our Service and agree to be bound by these Terms of Service ("Terms"), along with any additional terms, policies, or agreements referenced here or linked from this site, including our Shipping, Returns & Subscription Policy and our Privacy Policy. These Terms apply to everyone who accesses the site, including browsers, customers, vendors, affiliates, ambassadors, and anyone submitting content.

General Conditions; Right to Refuse Service

We reserve the right to refuse service to anyone, at any time, for any reason, including suspected fraud, chargeback abuse, unauthorized resale, harassment of our team, or violation of these Terms.

Information you submit through the site (excluding payment data) may be transmitted unencrypted across networks and may be altered to meet technical requirements of those networks. Payment information is always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell, resell, or otherwise exploit any part of the Service without our prior written permission.

Orders; Billing; Account Information

We reserve the right to refuse or cancel any order, including orders placed under the same account, payment method, or shipping/billing address. If we cancel or modify an order, we may attempt to contact you using the information provided at checkout.

You agree to provide accurate, current, and complete account and purchase information, and to keep it updated.

Returns, refunds, and order cancellations are governed by our Shipping, Returns & Subscription Policy.

Subscriptions & Recurring Billing

If you enroll in a subscription or recurring delivery option, you authorize Pure Nutrition to charge your chosen payment method for the initial order and all future recurring orders at the then-current subscription price, until canceled.

Cancellation

You may cancel your subscription at any time through your customer account portal or by emailing [Insert support email]. There are no cancellation fees or minimum commitment periods.

24-Hour Fulfillment Window: To stop an upcoming subscription shipment, cancellation requests must be submitted at least 24 hours before the scheduled billing date. Requests submitted after that point may arrive too late to halt an order already in fulfillment; that order will ship and may only be returned unopened, per our Shipping, Returns & Subscription Policy.

Shipping

Shipping timelines, carrier responsibility, and lost/damaged package handling are governed by our Shipping, Returns & Subscription Policy. If offered, package protection at checkout is optional; if declined, you acknowledge that Pure Nutrition is not responsible for loss, theft, or damage once a shipment leaves our facility, and any claim must be pursued with the carrier.

International Orders

International customers are the Importer of Record for their order and are responsible for any duties, taxes, customs fees, and compliance with the laws of their destination country. International return and refund eligibility is governed by our Shipping, Returns & Subscription Policy.

Third-Party Tools & Links

We may link to or provide access to third-party tools and websites that we do not control and do not monitor. These are provided "as is," without warranty, and we have no liability arising from your use of them. Links to third-party sites do not imply our endorsement, and we are not responsible for their content, accuracy, or practices.

User Content, Reviews & Feedback

If you submit reviews, testimonials, photos, videos, ideas, or other content ("Submissions") to us, you grant Pure Nutrition a non-exclusive, royalty-free, worldwide right to use, reproduce, edit, publish, and distribute that content across any medium, including marketing, without compensation to you, unless prohibited by law.

You represent that you own or control the rights to anything you submit and that our use of it won't infringe on anyone else's rights. We may remove any content that we determine, in our discretion, violates these Terms or applicable law.

Limitation of Liability

Where a jurisdiction does not permit the exclusion of certain damages, our liability is limited to the maximum extent permitted by law. Indemnification

You agree to indemnify and hold harmless Pure Nutrition Body LLC, its members, officers, employees, and affiliates from any claim or demand — including reasonable attorneys' fees — arising from your breach of these Terms, your violation of any law, or your violation of any third party's rights.

Dispute Resolution; Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Small Claims Carve-Out: Either party may bring an individual claim in small claims court in [Insert County], Iowa (or your county of residence, if outside Iowa), provided the claim qualifies for small claims court and is brought individually.

Agreement to Arbitrate: Except for small claims matters and disputes involving intellectual property or unauthorized access seeking injunctive relief, you and Pure Nutrition agree that any dispute arising from these Terms, your purchase, or your use of the Service will be resolved through binding individual arbitration rather than in court.

Arbitration Rules & Forum: Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and will take place in [Insert County], Iowa, unless otherwise agreed or required by law.

Class Action Waiver: YOU AND PURE NUTRITION AGREE THAT CLAIMS MAY ONLY BE BROUGHT INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims from more than one person.

Jury Trial Waiver: If a dispute proceeds in court rather than arbitration, both parties waive the right to a jury trial.

This arbitration provision survives termination of these Terms.

SMS/MMS Marketing Program Terms

By opting into our text messaging program, you agree to receive recurring automated marketing and/or transactional messages at the number provided. Consent is not a condition of purchase. Message and data rates may apply, and frequency varies.

Opt-Out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message to opt out at any time. Support: Reply HELP or email [Insert support email]. Email is not a valid method of opting out.

If you change or give up the phone number used to opt in, you agree to opt out beforehand, and to indemnify Pure Nutrition for claims (including under the TCPA) arising from a failure to do so.

This program is offered "as is" and delivery depends on your carrier's network, which is outside our control. You must be at least 13 to participate; if you are 13–17, you must have a parent or guardian's permission.

Termination

We may suspend or terminate your access to the Service at any time if, in our judgment, you violate these Terms. Obligations that by their nature should survive termination — including disclaimers, indemnification, and the arbitration agreement — will survive.

Entire Agreement; Severability

These Terms, together with any policies referenced here, form the entire agreement between you and Pure Nutrition Body LLC regarding the Service. If any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will stay in effect.

Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws principles.
